Overview
These Payment Plan Terms & Conditions (“Terms”) govern any purchase of a ready-made or custom doll (“Product”) on a payment plan (“Plan”). By enrolling in a Plan, you (“Customer”) agree to abide by these Terms. -
Plan Structure and Pricing
2.1 Payment Plan Pricing- The Company provides the Plan to accommodate the Customer’s budgetary needs. However, Plan purchases may incur a higher overall cost compared to paying in full. For example, if the standard full-payment price is $1200, monthly installments might total more than $1200 (e.g., 12 payments of $110 each).
- The specific Plan details (e.g., number of installments, installment amounts, total cost) will be disclosed to the Customer before finalizing the purchase.
2.2 Payment Schedule
- The Customer pays the first installment, which includes shipping fees (see Section 7), when enrolling in the Plan, unless otherwise specified in writing.
- Each subsequent installment is due as agreed (e.g., monthly or weekly). It is the Customer’s responsibility to submit each payment on time.

Grace Period and Consequences of Non-Payment
3.1 Grace Period- If a scheduled payment is not received on or before its due date, the Customer has a 17-day grace period from that date to pay the missed installment(s).
- During this 17-day period, the Customer may make late payment(s) without forfeiting prior installments.
3.2 Forfeiture of Payments
- If the overdue amount remains unpaid after the 17-day grace period, the Customer forfeits all previously paid installments as nonrefundable.
- At that point, the Company retains ownership of the Product and may sell or dispose of it at its sole discretion.

Non-Refundable Installments
- Each installment paid functions as a partial, nonrefundable deposit on the Product.
- The Customer will not receive a refund of any installment if they default on the Plan, cancel, or otherwise fail to complete all required payments, except where prohibited by applicable law.

Custom Orders
- For custom dolls, all installments paid are strictly nonrefundable once the order is placed.
- In the event of a default or failure to complete payment, the Company retains ownership of any partially completed custom doll and may modify or sell it at its discretion unless otherwise prohibited by law.

Ownership & Delivery
- Ownership of the Product remains with the Company until the full purchase price (including any additional fees or charges) has been paid.
- The Product will be shipped or made available for pickup only after the final installment has been paid and cleared.
- Delivery timelines for custom orders may vary based on production schedules.

Shipping Fees
- The Customer is required to pay any shipping and handling fees with the first installment.
- Shipping fees are nonrefundable in the event of a default or cancellation of the Plan, except where required by law.

Cancellation by Customer
- If the Customer cancels the Plan before completing all installments, any payments made are deemed nonrefundable deposits. The Product remains the property of the Company.

Cancellation or Modification by Company
- The Company reserves the right to cancel or modify the Plan if the Customer fails to comply with these Terms, engages in fraud, or if external circumstances beyond the Company’s control necessitate such changes.
- If the Company cancels the Plan for reasons unrelated to the Customer’s performance, the Customer is entitled to a refund of amounts paid, excluding any nonrefundable fees already disclosed.

Dispute Resolution

- Disputes arising out of these Terms should be addressed through good-faith negotiation first. If no resolution is reached, parties may pursue all legal remedies available under the applicable law.
- Governing Law

- These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered or operates, without regard to conflict-of-law principles.
- Severability

- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- Entire Agreement

- These Terms, along with the original purchase agreement, represent the entire understanding between the Company and the Customer regarding the Product and the Plan, superseding all prior communications and agreements.
